Retained by a demolition contractor to provide: pre-contract advice, contract negotiations, post-contract commercial advice, post-contract contractual advice, and claims advice.

Instructed by a Contractor to provide an Opinion on a complex scaffolding variation. SBCC contract interpretation, tender documentation, and post-contract discussions.

Providing advice to a Contractor on an Employer’s breach of contract (SBCC) in relation to a failure to provide possession for ~6 months. Advice continued to advise on extensions of time (contractual mechanisms) and loss and/or expenses for the delays.

Systech International / Costain Plc. Managing £100 million (steelwork and fit-out package) of a £2 billion nuclear defence project, including commercial contract management and quantity surveying. Managing and implementing over 500 compensation events, some contentious due to change. Providing commercial management services and dispute avoidance advice. Preparing, issuing and agreeing change orders.  Resolving a long-term issue with delays causing problems at C-level for all parties and assessing the value of 2,000 days of prolongation. Building a trusting relationship with the client, resulting in a contract extension from 3 months to 4.5 years

Instructed by a contractor to defend against a claim from an insolvent sub-contractor. Client retained full amount.

Instructed by a main-contractor to provide commercial and contractual support halfway through a difficult construction project. Provided advice in relation to extensions of time and loss and/or expense.

Instructed to review a client’s claim (prepared by others) in relation to ~270 variations, to advise on any issues and likelihood of success in adjudication.

Retained by a groundwork contractor to provide: post-contract assistance and preparation for adjudication proceedings. Settlement reached before adjudication commenced.

Party representative. Contractor against Employer regarding a payment application and claim for payment. Case succeeded with a full award in my Clients favour.

ICC Wales. Instructed to prepare a loss and/or expense for a sub-contractor against a main-contractor to an adjudication standard. Settled without the need for adjudication.

The Scalpel, London. Secured a settlement in a £40 million contract glazing dispute, ensuring correct administration and commercial management of the JCT contract. Maximised the client’s contractual position, minimised legal costs and successfully avoided a dispute. Reported directly to the client’s CEO and CFO.

Crossrail. Providing commercial management services to a steelwork sub-contractor in relation to the NEC3/4 contract, for works as part of Crossrail. Sub-contractor’s works included walkways, gantries etc.

Energy for Waste, Kidderminster. Managed the commercial contract prior to adjudication. Prepared a loss and expense claim. Drafted adjudication documents. Assisted with the representation of the client at the hearing. Secured a new commission at the University of Strathclyde from the same client, due to satisfaction with the way the original claim was handled.

Car garage & showroom. Stepped in to rescue a £6 million project that was over budget and over deadlines. Took over commercial management responsibilities including processing claims for payment, calculating and preparing loss and/or expense claims and assisted in drafting adjudication submissions. Managed two adjudication cases (quantum aspects) – both of which were found in the company’s favour.

Large commercial bakery. Commercial management: Managed the procurement of contract packages, including groundworks, steelworks and specialist equipment, for a £3.5 million bakery extension and a new build office. Set up contracts, agreed contracts sums, managed commercials on site, agreed price changes and variations, made applications for payment and reviewed and negotiated prolongation claims from contractors.

Managed numerous low-value, high-turnover projects, ranging from £200,000 to £4 million, in a fast-paced environment. Managed and trained an assistant.

Maintained excellent working relationships with clients, often in challenging circumstances, with everyone satisfied with the final outcomes.

Secured the role having been headhunted, due to a reputation for strong industry knowledge and results.
